Welcome to Talent Q ("we," "us," "our," or the "Company"). Talent Q is operated by Affect Group Inc. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our website located at talentq.me and app.talentq.me (the "Website"), our mobile applications (the "App"), and our services (collectively, the "Services").

Talent Q provides AI-powered personality and talent analysis services based on birth data (date, time, and place of birth). Our Services include:

Talent Analysis: Calculation of 180 innate potentials based on over 150,000 parameters

AI Psychological Profiles: Generation of detailed personality profiles using artificial intelligence

AI Mentor: Personalized recommendations and insights based on your profile

Daily AI Insights: Personalized daily recommendations and guidance (subscription feature)

Compatibility Analysis: Comparison with friends via personal codes (with mutual consent)

Public Demonstration Profiles: Example profiles of public figures for demonstration purposes

2.1 Important Disclaimers

NATURE OF THE SERVICE: Our Services provide self-knowledge insights based on date, time, and place of birth. The AI-generated profiles, talent scores, and insights are intended to complement, not replace, the user's own judgment and consultation with qualified professionals. They are NOT a substitute for medical, psychological, legal, financial, or career counseling. Always consult qualified professionals for important life decisions.

2.2 Public Figure Demonstration Profiles

Talent Q may display demonstration profiles of public figures (celebrities, business leaders, historical figures, etc.) for illustrative purposes. These profiles are calculated algorithmically using publicly available birth date data from open sources (Wikipedia, public records, biographical databases).

The calculations are provided solely to demonstrate how the Service works. We make no claims regarding the accuracy of these profiles or their correspondence to any real person’s actual abilities or characteristics. The display of public figure profiles does not constitute advertising.

3. INFORMATION WE COLLECT

3.1 Information You Provide

We collect information you voluntarily provide when using our Services:

Account Information: Email address, password, profile name

Birth Data: Date of birth, time of birth, place of birth — essential for talent calculations

AI Mentor Conversations: Messages and queries you send to the AI Mentor

Questionnaire and Essay Responses: Free-text answers you provide in personality questionnaires and self-reflection essays within the Service. These responses may contain personal information of any nature, including potentially sensitive data (health, beliefs, personal life), which you share voluntarily.

Rectification Questionnaire Responses: If you purchase Birth-Time Rectification, you provide structured responses to a questionnaire of significant life events (e.g., relationships, career changes, relocations, health events, family events). These responses may contain Sensitive Personal Information under the CCPA/CPRA (Cal. Civ. Code § 1798.140(ae)), such as health information or information about religious or philosophical beliefs. We process these responses only on the basis of your explicit, informed consent given at the time of purchase, and only for the purpose of performing the rectification service. We will not use these responses to train AI models, for marketing, or for any other purpose without your separate consent.

Shadow Mentor Conversations and Shadow Questionnaire: If you activate the Shadow Profile module, we collect your answers to the shadow questionnaire and the messages you exchange with the Shadow Mentor. This content may include special category personal data that you share voluntarily. We process it only on the basis of your explicit consent (GDPR Art. 9(2)(a)) given at module activation, and only to provide the module. We do not use this content to train AI models. See Section 4.3.

Payment Information: Processed securely by third-party payment processors; we do not store full payment card details

Support Communications: Messages you send to our support team

Note on Names: We do not intentionally collect your full legal name. Your profile name may be a nickname or alias. Your real name may only appear if you voluntarily provide it in your profile, AI Mentor conversations, questionnaire responses, or support messages.

Talent Calculations: 180 calculated talent scores based on your birth data

AI Psychological Profiles: AI-generated personality descriptions and insights

Daily Insights: Personalized recommendations generated for subscribers

Comparison Results: Compatibility analyses when you compare profiles with friends

Shadow Calculations: If you activate the Shadow Profile module — 200 computed shadow-inclination indicators based on your birth data, the AI-generated shadow profile, and your work plan

3.3 Automatically Collected Information

Device Information: Device type, operating system, unique device identifiers

Usage Data: Features used, pages visited, time spent, actions taken

Log Data: IP address, browser type, access times, referring URLs

Cookies and Tracking: Cookies and similar technologies for analytics and functionality

4. SENSITIVE PERSONAL DATA

The AI-generated psychological profiles may be considered sensitive personal data under certain privacy laws (such as GDPR). By using our Services, you explicitly consent to the processing of this data for the purposes described in this Policy.

Important: AI-generated profiles are algorithmic interpretations intended to support self-knowledge and personal reflection, and do not constitute actual psychological assessments or diagnoses.

4.1 Special Categories of Personal Data

Some Users may voluntarily provide special category personal data (as defined in GDPR Art. 9: data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership; genetic data, biometric data, data concerning health, data concerning a natural person's sex life or sexual orientation) in free-text fields such as questionnaire essays or AI Mentor conversations. We process such data ONLY with the User's explicit consent under Art. 9(2)(a) GDPR (or equivalent provision in CCPA/PDP), for the sole purpose of providing the personalized analysis the User has requested. Users may withdraw consent and request erasure at any time via [email protected].

4.2 Aggregated and Anonymized Data

We may process aggregated, anonymized data derived from User content (e.g., to improve our talent classification algorithm or to publish aggregate insights). Such aggregated data is not personal data under applicable privacy laws and is not subject to data subject rights. We ensure aggregated data cannot be re-identified.

4.3 Shadow Mentor Conversations and Shadow Questionnaire

The Shadow Profile module involves a direct conversation about hindering sides of personality. Your shadow questionnaire answers and Shadow Mentor conversations may therefore reveal special category personal data as defined in GDPR Art. 9 (for example, data concerning health or beliefs). We process this data only with your explicit consent under Art. 9(2)(a) GDPR (or the equivalent provision of the privacy law applicable to you), which you give when activating the module, and for the sole purpose of providing the module: generating the shadow profile and the Shadow Mentor’s responses. We do not use this content to train AI models, for marketing, or for any other purpose without your separate consent. These conversations and answers are stored so that you can return to your work in the module: they are retained until you delete them or your account, whichever occurs first (conversations can be deleted in the app; questionnaire answers are deleted on request via [email protected]; see Section 11), and are encrypted at rest. You may withdraw your consent at any time via [email protected]; after withdrawal the Shadow Mentor and the shadow questionnaire can no longer be provided, while the shadow profile computed from your birth data remains available in your account. Withdrawal does not affect the lawfulness of processing carried out before it.

5. HOW WE USE YOUR INFORMATION (LAWFUL BASIS TABLE)

We use collected information for the following purposes, each on the lawful basis indicated. GDPR Article references are included for users who also have rights under the EU/UK GDPR; equivalent bases under U.S. state privacy laws apply for U.S. residents.

Additional supporting purposes:

Payment Processing: To process purchases, subscriptions, and message packages

Friend Comparison: To enable profile comparisons via personal codes

Communications: To send service-related notifications and respond to inquiries

Legal Compliance: To comply with legal obligations and protect our rights

AI Training: Anonymized and aggregated data may be used to improve AI accuracy

Performing Birth-Time Rectification: Authorized personnel — including operators acting under our supervision and supervised AI processing tools — review your questionnaire responses to estimate your birth time and may contact you by email with clarifying questions. The result is reviewed by a human operator before delivery (not solely automated decision-making). Your rectification responses are not used for any other purpose, and not used for AI training, without your separate consent.

6. FRIEND COMPARISON FEATURE

Our personal code feature allows you to share your profile with friends for compatibility analysis.

Portions of your AI-generated psychological profile

Compatibility analysis between your profiles

6.2 Your Responsibilities

Only share your code with people you trust

You control who receives your code

You may generate a new code to revoke previous access

7. THIRD-PARTY SERVICE PROVIDERS

We work with third-party service providers to operate our Services. These providers have access to your information only to perform specific tasks on our behalf and are obligated to protect your data.

Categories of service providers include:

Cloud Infrastructure Providers: For hosting, data storage, and server infrastructure

AI Technology Providers: For powering AI Mentor responses and profile generation

Payment Processors: For secure handling of payment transactions

Analytics Providers: For understanding usage patterns and improving Services

Email Service Providers: For sending transactional and service emails

Authorized personnel performing manual review of Birth-Time Rectification questionnaires (e.g., operators acting under written confidentiality obligations) may be located outside your country and may process your data using the service providers listed above. All such processing occurs under appropriate contractual and technical safeguards. A list of specific subprocessors is available on request to [email protected].

8. ADVERTISING AND RETARGETING

We may share your email address with advertising platforms (such as Meta, Google) to deliver personalized advertisements. This allows us to show you relevant ads on third-party platforms based on your interest in our Services.

11. DATA RETENTION

Account Data: Retained while your account is active and for up to 3 years after account deletion request to handle legal claims and disputes

Talent Calculations & AI Profiles: Retained while your account is active; deleted within 90 days of account deletion request

AI Mentor Conversations: Retained for 12 months after generation for service improvement, then anonymized or deleted

Payment Records: Retained for 7 years as required by U.S. tax and accounting regulations

Analytics Data: Retained for up to 14 months in identifiable form, then anonymized; aggregated and anonymized data may be retained indefinitely

Rectification Questionnaire Responses: Retained for up to 12 months from delivery of the result, then deleted, unless you request earlier deletion. This window allows us to reopen the case if you provide additional information.

Shadow Mentor Conversations and Shadow Questionnaire: Retained until you delete them or your account, so that you can return to your work in the module (conversations can be deleted in the app; questionnaire answers are deleted on request via [email protected]); deleted within 90 days of an account deletion request

Upon account deletion request, we will delete or anonymize your data within a reasonable timeframe, except where retention is required by law.

12. DATA SECURITY

We implement appropriate technical and organizational measures to protect your personal data, including:

Access controls limiting data access to authorized personnel

Personal data collected: email address, IP address (for fraud prevention), referral source.

Purpose of processing:

To deliver the requested resource (e.g., classification preview link).

With your additional consent, to send you product updates, educational content, and marketing communications about Talent Q.

Legal basis (CCPA/CPRA — for California residents; equivalent business-purpose disclosures apply to other U.S. state-law residents):

For delivering the requested resource: performance of a requested service (pre-contract / business purpose).

For marketing communications: your opt-in consent (email-based).

Retention: We retain prospective-customer email addresses for up to two (2) years from the last interaction. After this period, we delete or anonymize the data unless you have created a User account.

Your rights: You have the same rights as Users under this Privacy Policy, including the right to request access, correction, deletion, or opt-out of marketing emails. To unsubscribe from marketing emails, click the unsubscribe link in any email or contact [email protected].

If you create a full User account, your prospective-customer record is merged into your User account and the User Privacy Notice supersedes this Notice.

15. CHILDREN’S PRIVACY AND PARENTAL CONSENT

Talent Q does not allow direct registration by users under 16 years of age. Parents or legal guardians may register on behalf of a minor, in which case:

• The parent or guardian acknowledges that they hold parental authority and consent to the processing of the minor's personal data
• The registration email and email-verification link confirm parental consent
• All rights and obligations under this Privacy Policy and our Terms of Service apply to the parent or guardian acting on behalf of the minor

Parents and legal guardians may also use our Services to analyze birth data of their children of any age. By entering a child's birth data, the parent or guardian confirms they have the legal authority to provide this information and consent to its processing on behalf of the child.

If you believe a child under 16 has created an account without parental consent, please contact us at [email protected], and we will delete such account.

16. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time. Material changes will be notified via email or through the Services. Your continued use of the Services after changes constitutes acceptance of the updated Privacy Policy. We encourage you to review this Policy periodically.

16A. TESTIMONIALS / USER STATEMENTS

The Talent Q website displays testimonials from real Users — including their names, photos, and statements. Each individual depicted has provided written consent (typically via email or messaging-platform exchange) authorizing use of their likeness and statement for marketing purposes. Consents are retained on file and may be revoked at any time by emailing [email protected]; on revocation, the testimonial is removed within fourteen (14) days. This use is consistent with the right-of-publicity laws of the user's state of residence.

16B. PUBLIC-FIGURE COMPATIBILITY COMPARISON

The Talent Q App allows registered Users to compare their personal innate-talents profile against algorithmically-derived profiles of public figures (historical and contemporary celebrities, business leaders, scientists, artists, etc.). Public-figure profiles are computed from publicly-available biographical data (date and place of birth, available in open-source biographical databases — Wikipedia, public records, biographical encyclopedias, etc.). No biometric, sensitive, or non-public data of public figures is collected or processed. The User's own data is processed locally for the comparison and is not shared with any third party. This use is consistent with U.S. fair-use principles for public-domain biographical information.

18. NOTICE TO CALIFORNIA RESIDENTS (CCPA/CPRA)

This section applies to California residents and supplements the rest of this Privacy Policy. It is provided pursuant to the California Consumer Privacy Act of 2018 ("CCPA"), as amended by the California Privacy Rights Act ("CPRA").

18.3 Right to Opt Out of Sale or Sharing (CCPA §1798.120)

We do not sell or share personal information for cross-context behavioral advertising as those terms are defined under the CCPA/CPRA. Because we do not engage in such sales or sharing, no "Do Not Sell or Share My Personal Information" link is required. You may still email us at [email protected] to confirm or to object to any future change in this practice.

Note: We do not run advertising-based marketing. We do not enable conversion tracking pixels (Meta, Google Ads, etc.). Stripe Conversion Tracking is not enabled.

18.4 Right to Correct (CPRA §1798.106)

You have the right to request correction of inaccurate personal information that we maintain about you.

18.5 Right to Limit Use of Sensitive Personal Information (CPRA §1798.121)

California residents have the right to limit our use and disclosure of "sensitive personal information" to those uses necessary to provide the Services or as otherwise permitted by law. Birth data and AI-generated psychological profiles may qualify as sensitive personal information. We use such information solely for the purposes described in Section 5 of this Policy.

18.6 Right to Non-Discrimination

We will not discriminate against you for exercising any of your CCPA/CPRA rights. We will not deny goods or services, charge different prices, or provide a different level of service because you have exercised these rights.

18.7 Authorized Agents

You may designate an authorized agent to make a request on your behalf by providing the agent with written, signed permission to do so. We will require the agent to provide proof of your written authorization and may require you to verify your identity directly with us.

18.8 Categories of Personal Information Collected

Within the 12 months preceding the effective date of this Policy, we have collected the following categories of personal information defined under the CCPA:

Identifiers: Identifiers (email address, profile name, account ID, IP address, device identifiers)

Commercial information: Commercial information (subscription and purchase history)

Internet activity: Internet or other electronic network activity (interactions with the Services, log data)

Inferences: Inferences drawn to create a profile reflecting the user's preferences, characteristics, and aptitudes (AI-generated talent and personality profiles)

Sensitive personal information: Sensitive personal information (date, time, and place of birth; free-text questionnaire and AI Mentor responses that may contain health or belief information voluntarily shared by you; shadow questionnaire answers and Shadow Mentor conversations if you activate the Shadow Profile module)

18.9 Shine the Light

California's "Shine the Light" law (Cal. Civ. Code §1798.83) permits California residents to request information regarding our disclosure of personal information to third parties for those parties' direct-marketing purposes. We do not disclose personal information to third parties for their direct-marketing purposes.

18.10 How to Exercise Your California Rights

To exercise any of the rights described above, contact us at [email protected] with the subject line "California Privacy Rights Request". We will verify your identity by matching information you provide against our records and will respond within the timeframes required by the CCPA (generally 45 days, extendable by an additional 45 days where reasonably necessary).

19. NOTICE TO OTHER U.S. STATE RESIDENTS

Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Tennessee, Indiana, New Hampshire, New Jersey, Delaware, Minnesota, and Rhode Island have rights under their state's data protection law similar to those listed in §18 (Notice to California Residents). To exercise rights, follow the same procedure as California residents.

20. GOVERNING LAW

This Privacy Policy shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. AI Mentor: Personalized recommendations, insights, and responses to your queries

Daily AI Insights: Personalized daily recommendations and guidance (subscription feature)

Compatibility Analysis: Comparison with friends via personal codes (with mutual consent)

Knowledge Base: Educational content about talents and personal development

Birth-Time Rectification: An analytical service that estimates a likely birth time from your structured questionnaire responses and significant life events, using a proprietary computational methodology. Available as a premium service in select plans.

Shadow Profile Module: An analytical portrait of predispositions that may manifest as hindering (“shadow”) behaviour patterns, with access to the Shadow Mentor — an AI mentor for working through them. Available as a separate one-time purchase (premium service) for users 18+ (see Section 2.5).

2.2 Nature of the Service

Talent Q provides self-knowledge insights based on date, time, and place of birth using a proprietary methodology. Insights are intended to complement, not replace, the user's own judgment and consultation with qualified professionals. 2.3 Birth-Time Rectification (Premium Service)

Birth-Time Rectification is a premium analytical service available in select plans. It estimates a likely birth time from your structured questionnaire responses and significant life events, using a proprietary computational methodology that may include iterative analysis, comparison of computed profiles across candidate times, and clarifying follow-up questions sent by email.

Nature of the Service.

The estimated birth time and any insights derived from it are intended as reflective tools to complement, not replace, your own judgment and the advice of qualified professionals. We do not guarantee the accuracy of the estimate, make no predictions about future events, and do not offer medical, psychological, legal, financial, or career counseling. Where applicable law regulates "fortune telling," divination, or analogous services, this Service is offered solely as a self-knowledge analytical methodology and not as such regulated activity.

Beta / Pilot Status.

The methodology is undergoing ongoing validation. We do not guarantee any specific accuracy threshold, and you acknowledge that the estimate is a best-effort result based on the information you provide.

Your Obligations.

You are responsible for providing truthful and accurate event data. Inaccurate or incomplete responses may produce an incorrect estimate and are not grounds for a refund.

Authorized Personnel.

Performance of the Service involves manual review of your questionnaire responses by authorized personnel acting under written confidentiality obligations and, where applicable, supervised AI processing tools. See our Privacy Policy for details.

Refund Policy for Rectification.

Because rectification requires manual review of your responses, refund eligibility depends on stage:

Full refund if you have not yet submitted the questionnaire.

Partial refund (50%) within 7 days of submission if no follow-up questions have been sent and no final result has been delivered.

No refund after the final result has been delivered or after follow-up questions have been answered.

2.4 Public Figure Demonstration Profiles

Talent Q may display demonstration profiles of public figures (celebrities, business leaders, historical figures, etc.) for illustrative purposes. These profiles are calculated algorithmically using publicly available birth date data from open sources (Wikipedia, public records, biographical databases).

The calculations are provided solely to demonstrate how the Service works. We make no claims regarding the accuracy of these profiles or their correspondence to any real person’s actual abilities or characteristics. The display of public figure profiles does not constitute advertising.

2.5 Shadow Profile Module (Premium Service)

The Shadow Profile module is a premium self-development tool available as a separate one-time purchase. Based on your birth data, it computes an analytical portrait of predispositions that may manifest as hindering (“shadow”) behaviour patterns, and includes access to the Shadow Mentor — an AI mentor for working through these shadow sides and transforming them into healthy forms for self-development and the realization of your potential. The shadow profile and the Shadow Mentor’s responses are generated by an AI system.

Nature of the Module.

The module describes predispositions computed using our proprietary methodology from your birth configuration. It is not a diagnosis, a psychological assessment, or a statement of fact about you, and it is not psychological diagnostics, therapy, or a substitute for them. The Shadow Mentor is not a therapist or a licensed professional. The materials are intentionally written in direct language and may address uncomfortable sides of personality. The AI Mentor terms in Section 6, including its limitations and its inability to provide crisis intervention, apply in full to the Shadow Mentor, except that Shadow Mentor conversations are used solely to provide the module and are not used to improve services or to train AI models (see the Privacy Policy).

Eligibility (18+).

The module is available only to users who are at least 18 years of age, and only for your own profile. It is not available on accounts registered by a parent or legal guardian to analyze a child’s data, and it is not offered for children’s profiles.

Activation Acknowledgements and Consent.

Before the purchase you must confirm the acknowledgements presented at activation: that you are 18 years of age or older; that you understand the module is a self-development tool and not psychological diagnostics, therapy or a substitute for them; that you are making the decision consciously and will use the materials at your own responsibility; that you will have no claims against the service regarding the content of the shadow profile or the Shadow Mentor’s responses; and that you are ready for a direct conversation about yourself. You must also give a separate explicit consent to the processing of your shadow questionnaire answers and Shadow Mentor conversations (see the Privacy Policy). The module cannot be activated without these confirmations.

Shadow Mentor Requests.

The module price does not include AI Mentor request credits. Each Shadow Mentor response deducts two (2) requests from your shared AI Mentor request balance, because each shadow-work request processes substantially more information (your talent profile, questionnaires, and shadow materials). Additional requests may be purchased as message packages under Section 9.1. The shadow profile itself remains available in your account regardless of your request balance.

Refunds.

The general refund policy in Section 9.4 applies to the module: the service is considered rendered at the moment the shadow profile is displayed. No special refund terms apply to the module.

Limitation of Liability.

To the maximum extent permitted by applicable law, the disclaimers in Section 11 and the limitation of liability in Section 12 apply in full to the module, including the content of the shadow profile, the Shadow Mentor’s responses, and emotional reactions to these materials.

3. ELIGIBILITY

To use the Services, you must:

Be at least 16 years of age (or the age of digital consent in your jurisdiction, if higher)

Confirm your age during registration by checking the required checkbox

Have the legal capacity to enter into a binding agreement

Not be prohibited from using the Services under applicable laws

Provide accurate and complete information during registration

Children's Data and Parental Consent: Talent Q does not allow direct registration by users under 16. Parents or legal guardians may register on behalf of a minor, in which case the parent or guardian acknowledges they hold parental authority and consent to the processing of the minor's data; the registration email and verification link confirm parental consent; and all rights and obligations under these Terms apply to the parent or guardian acting on behalf of the minor. Parents and legal guardians may also use our Services to analyze birth data of their children of any age; by entering a child's birth data, the parent or guardian confirms they have the legal authority to consent to data processing on behalf of the child. If you believe a child under 16 has created an account without parental consent, please contact us at [email protected].

4. ACCOUNT REGISTRATION AND SECURITY

4.1 Account Creation

To access certain features, you must create an account. You agree to:

Provide accurate, current, and complete registration information

Maintain and promptly update your account information

Keep your password confidential and secure

Notify us immediately of any unauthorized account access

Accept responsibility for all activities under your account

4.2 Birth Data Accuracy

The accuracy of the analysis depends on the accuracy of the birth data you provide. The analysis results are intended to support self-knowledge and personal reflection only, and we are not responsible for any decisions made based on them, regardless of the accuracy of the data provided.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Services ceases immediately.

5. USER CONDUCT AND PROHIBITED ACTIVITIES

By using the Services, you agree NOT to:

5.3 Technical Prohibitions

Attempt to gain unauthorized access to our systems or networks

Use automated means (bots, scrapers) to access the Services

Reverse engineer, decompile, or disassemble any part of the Services

Introduce viruses, malware, or other harmful code

Interfere with the proper functioning of the Services

Circumvent security measures or access controls

5.4 AI System Prohibitions

Attempt to jailbreak, manipulate, or bypass AI operational constraints

Use prompt injection or other techniques to circumvent content policies

Attempt to extract system prompts or training data

Engage in adversarial testing without authorization

Use the AI Mentor for illegal, harmful, or unethical purposes

6. AI MENTOR SPECIFIC TERMS

6.1 Nature of AI Mentor

The AI Mentor is an artificial intelligence system, NOT a human. It provides content and responses to support self-knowledge and personal reflection. The AI Mentor is NOT a licensed professional and its responses should not be considered professional advice for medical, psychological, legal, financial, or career matters.

6.2 Limitations

The AI may not understand or correctly process all information you share

Responses may contain inaccuracies or be inappropriate for your situation

The AI cannot respond to emergencies or provide crisis intervention

AI conversations are logged and may be used to improve services

6.3 Third-Party Information

WARNING: Do not share personal information about third parties without their consent. The AI may inadvertently process, analyze, or reference information about others. You assume responsibility for any information you share about other people.

7. FRIEND COMPARISON AND SOCIAL FEATURES

7.1 Personal Codes

Talent Q allows you to share your profile with friends via personal codes. By sharing your code, you consent to sharing the following information:

All 180 calculated talent scores

Portions of your AI-generated psychological profile

Compatibility analysis data

7.2 Consent and Responsibility

Only share your code with people you trust

You may generate a new code to revoke previous access

You are responsible for how your shared data is used by recipients

7.3 Public Profile Sharing

You may create a public share page displaying your name, top talents, archetypes, and AI-generated descriptions. By creating a public share link, you understand and agree that:

This information becomes publicly accessible to anyone with the link

Your public share page may include your referral link

You may deactivate your public share page at any time through your account settings

You are responsible for any consequences of sharing your profile publicly

8. INTELLECTUAL PROPERTY RIGHTS

8.1 Our Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, software, algorithms, and the compilation thereof, are the exclusive property of Talent Q or its licensors and are protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. This license does not include any right to:

Modify, copy, distribute, or create derivative works

Use the Services for commercial purposes without authorization

Remove or alter any copyright or proprietary notices

Transfer your access to any third party

9. PAYMENTS AND SUBSCRIPTIONS

9.1 Payment Options

Talent Q offers the following payment options:

One-Time Purchase: Access to talent calculation, AI profile generation, knowledge base, additional AI queries, and one month of daily insights

Subscription: Ongoing access to daily AI insights generation (monthly or other periods)

Message Packages: Additional AI Mentor message credits

Shadow Profile Module: One-time purchase of the shadow profile and Shadow Mentor access (AI request credits not included; each Shadow Mentor response deducts 2 requests from the shared request balance)

9.2 Auto-Renewal

Subscriptions automatically renew unless cancelled before the end of the billing period

You may cancel subscriptions through your account settings or app store

Cancellation takes effect at the end of the current billing period

Deleting the app does not automatically cancel your subscription

9.3 Pricing

Prices are displayed in USD and may vary. We reserve the right to change prices at any time. Promotional discounts may apply under certain conditions.

9.4 Refunds

Refunds are not issued after the User has received their talent calculation results, as the service is considered rendered at the moment the results are displayed. Exceptions apply only in case of a technical failure that prevents delivery of the service, and at the Company's sole discretion. Purchases made through the Apple App Store or Google Play are subject to their respective refund policies. Subscriptions may be cancelled at any time via account settings; cancellation does not refund amounts already paid for the current billing period.

10. REFERRAL PROGRAM

Talent Q may offer referral rewards for users who invite others to the Service.

Rewards (such as additional AI Mentor requests) are credited when the referred user completes a qualifying purchase

Rewards are non-transferable and have no cash value

We reserve the right to modify or terminate the referral program at any time without prior notice

Abuse of the referral system (including fake accounts, self-referrals, or fraudulent activity) may result in forfeiture of rewards and account termination

Demonstration profiles of public figures are algorithmic calculations based on publicly available birth date data. They are provided solely to demonstrate the Service’s capabilities. We make no claims regarding their accuracy or correspondence to any real person’s actual abilities.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

IN NO EVENT SHALL Talent Q, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

THE TOTAL LIABILITY OF Talent Q SHALL NOT EXCEED THE FEES YOU PAID TO Talent Q IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, BUT IN ANY CASE SHALL NOT BE LESS THAN THE LESSER OF (A) ONE HUNDRED US DOLLARS (USD 100) OR (B) THE AMOUNT YOU ACTUALLY PAID TO Talent Q.

WE SHALL NOT BE LIABLE FOR ANY DAMAGES RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE SERVICES; (B) ANY DECISIONS MADE BASED ON INFORMATION PROVIDED BY THE SERVICES; (C) UNAUTHORIZED ACCESS TO YOUR ACCOUNT; (D) ERRORS OR INACCURACIES IN AI-GENERATED CONTENT; (E) ANY THIRD-PARTY CONTENT OR CONDUCT.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Talent Q and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney’s fees) arising from:

14.3 Class Action Waiver

YOU AND Talent Q AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of class or representative proceeding.

14.4 Opt-Out

You may opt out of the arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms. The notice must include your name, address, email, and a clear statement that you wish to opt out.

15. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. For users in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.

4. AI MENTOR USAGE

When using the AI Mentor feature:

• Remember the AI is not a human and not a substitute for professional help
• Do not attempt to manipulate or “jailbreak” the AI
• Do not use the AI for illegal, harmful, or unethical purposes
• Do not share personal information about others without consent
• Do not request harmful, explicit, or illegal content
• Report any concerning AI responses to support

5. FRIEND COMPARISON ETIQUETTE

When using the friend comparison feature:

• Only share your personal code with people you trust
• Understand that sharing reveals your talent scores and portions of your AI profile
• Respect others’ privacy regarding comparison results
• Do not share comparison results publicly without consent
• Do not use comparison results to harass or demean others
• Remember that talent profiles are intended for self-knowledge and personal reflection

6. SPAM AND FRAUD PREVENTION

To maintain a quality community:

• No spam, chain messages, or unsolicited advertising
• No pyramid schemes or multi-level marketing promotions
• No fake accounts or impersonation
• No harvesting of user data
• No deceptive or misleading content
• No commercial solicitation without authorization

7. INTELLECTUAL PROPERTY

• Only share content you own or have rights to share
• Respect copyrights, trademarks, and other intellectual property
• Do not copy or redistribute Talent Q’s proprietary content
• Report any content that infringes on your intellectual property

8. PRIVACY AND PERSONAL INFORMATION

• Do not share your personal codes publicly
• Do not share others’ personal information without consent
• Protect your account credentials
• Do not post sensitive information (addresses, phone numbers, etc.)
• Respect the privacy settings chosen by other users

9. REPORTING VIOLATIONS

If you encounter content or behavior that violates these guidelines:

• Use the in-app reporting feature to flag content

• Provide as much detail as possible about the violation
• Do not engage with or retaliate against the violator

10. REVIEW TIMELINE

We aim to review reports within fourteen (14) days. Some complex matters may take longer.

11. ENFORCEMENT

Talent Q has a zero-tolerance policy for serious violations of these Community Guidelines. Consequences may include:

• Content removal
• Warning notification
• Temporary suspension of account features
• Permanent account termination
• Reporting to law enforcement when appropriate
• Legal action in extreme cases

We reserve the right to take any action we deem appropriate to protect our community, at our sole discretion.
